FORT WORTH, Texas – Scott Fraley and Heather Kanny won an interlocutory appeal filed on behalf of an Arlington-based assisted living facility. The appeal was heard by the Fort Worth Court of Appeals for the Second District of Texas. The Fort Worth Court of Appeals reversed and remanded the trial court’s order denying Defendant’s Motion to Dismiss based on Chapter 74 of the Civil Practice and Remedies Code. The Court of Appeals remanded the case to the trial court for the purpose of awarding attorneys’ fees and costs to Defendant. (Town Hall Estates –Arlington, Inc. v. Cannon, No. 02-10-00185-CV).
